Terms of Service

1. Acceptance of Terms
By accessing or using the SuperMemo website, software, and associated services (collectively, the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to all of these Terms, you may not access or use the Service.
2. The Service
SuperMemo is the original spaced repetition software designed to enhance long-term memory retention. The Service provides access to licensing, downloads, and information related to the SuperMemo software application (the "Software").
3. User Accounts and License Grant
3.1 Account Registration
To purchase or use the Software, you must register for a user account. You are responsible for maintaining the security of your account and password. You must notify us immediately upon becoming aware of any unauthorized use of your account.
3.2 Perpetual License Grant
Upon completion of your purchase, SuperMemo World grants you a non-exclusive, perpetual, worldwide license to use the version of the Software purchased (the "Licensed Version"), subject to these Terms.
3.3 Updates
During periods when the Software is under active development, you are entitled to receive all minor updates and patches to the Licensed Version (e.g., versions 19.3, 19.4, 19.5) at no additional cost. Major version upgrades (e.g., version 19 to version 20) may be offered as a separate purchase.
3.4 Transferability
This license is transferable. You may transfer your license to another individual or to another computer, provided that the license is used by only one individual at any given time. You may not rent, lease, or sub-license the Software.
4. Purchase, Payment, and Refunds
4.1 Payment
All payments for the Software are processed by our third-party payment processor, Stripe. By making a purchase, you agree to Stripe's terms of service. Prices are stated in the applicable currency at the time of purchase.
4.2 Refund Eligibility
Because the Software is a downloadable, perpetual product, all purchases are final, except as described below.
4.3 Material Errors
If the Software contains a material error that fundamentally prevents it from functioning as described in the official documentation, and we are unable to remedy that error within a reasonable period after you notify us, you may be eligible for a refund at our discretion.
4.4 Bug Reporting
We are dedicated to improving the Software. If you encounter a non-critical bug or technical issue, you agree to contact our support team to allow us a reasonable opportunity to address the issue. The presence of minor bugs does not entitle you to a refund.
4.5 No Refunds for Learning Outcomes
You acknowledge that the Software is a tool designed to assist with memorization. Individual learning outcomes depend on various factors outside of our control, including your personal study habits, engagement, and cognitive factors. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT REFUNDS WILL NOT BE ISSUED BASED ON SUBJECTIVE LEARNING RESULTS, FAILURE TO MEET PERSONAL MEMORIZATION TARGETS, OR DISSATISFACTION WITH THE SPACED REPETITION ALGORITHM'S PREDICTIONS.
5. User Conduct
You agree not to use the Service for any unlawful purpose or to violate any applicable laws in your jurisdiction. You may not reverse engineer, decompile, or attempt to extract the source code of the Software, except to the extent expressly permitted by applicable Polish law.
6. Intellectual Property
SuperMemo World and its licensors exclusively own all rights, title, and interest in and to the Service, the Software, the SuperMemo brand, and related materials. These Terms do not grant you any intellectual property rights in the Service except for the limited license to use the Software as expressly set forth in Section 3.
7. Disclaimer of Warranties
THE SERVICE AND SOFTWARE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE POLISH LAW, SUPERMEMO WORLD HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SUPERMEMO WORLD DOES NOT WARRANT THAT:
- (a) THE SOFTWARE WILL MEET YOUR SPECIFIC LEARNING REQUIREMENTS OR ENABLE YOU TO MEMORIZE SPECIFIC INFORMATION;
- (b) THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; OR
- (c) ANY DEFECTS OR ERRORS IN THE SOFTWARE WILL BE CORRECTED.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SUPERMEMO WORLD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR USE OR INABILITY TO USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (iii) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
9. Termination
9.1 Termination by You
You may terminate your account at any time by discontinuing use of the Service.
9.2 Termination by Us
We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.
9.3 Survival
Upon termination, your right to use the Service will immediately cease. However, any provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in Poland.
